Terms of Use

1. Acceptance of Terms

By accessing or using Clock Deck ("Service"), operated by Clock Deck LLC ("Company," "we," "us"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

Clock Deck is a cloud-based time tracking and workforce management platform. Features include employee clock-in/out, scheduling, timesheet management, GPS verification, photo verification, and agency/multi-business management. Feature availability depends on your subscription plan.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorized use. You must be at least 18 years old or the age of majority in your jurisdiction to create an account.

4. Subscription Plans & Billing

Clock Deck offers multiple subscription tiers (Basic, Pro, Enterprise, and Agency). By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are stated in U.S. dollars.

  • Free Trials: Certain plans include a free trial period. You will not be charged during the trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan.
  • Billing Cycle: Subscriptions are billed monthly. Mid-cycle upgrades are prorated for the remainder of the billing period.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.
  • Payment Processing: Payments are processed securely through our PCI-compliant payment processor. We do not store your card details on our servers.

5. Agency Accounts

Agency/CPA accounts may manage multiple client businesses. The base plan includes a specified number of client businesses. Additional businesses are billed at the published per-business rate. Agency account owners are responsible for ensuring their clients' compliance with these Terms.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Transmit malware, viruses, or harmful code
  • Interfere with the performance or availability of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools to scrape or extract data from the Service
  • Share credentials or allow unauthorized third parties to access the Service through your account

7. Data Ownership & Privacy

You retain ownership of all data you submit to the Service. We use your data solely to provide and improve the Service. Our collection and use of personal information is governed by our Privacy Policy. You are responsible for obtaining any required consents from your employees regarding data collection, including GPS and photo data.

8. Intellectual Property

The Service, including its design, code, features, and content, is the exclusive property of Clock Deck LLC and is protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

9. Service Availability & Modifications

We strive for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes that affect your use. Scheduled maintenance will be communicated in advance when possible.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOCK DECK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Clock Deck LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or for any other reason at our discretion with reasonable notice. Upon termination, your right to use the Service ceases immediately. You may export your data prior to termination. We may retain anonymized, aggregated data for analytical purposes.

13. Dispute Resolution

These Terms are governed by the laws of the State of Idaho, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits or class-wide arbitration.
